1. Acceptance of Terms

By accessing or using ToneYin (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

ToneYin is a Mandarin pronunciation coaching application. You record short prompted phrases, and ToneYin’s AI grades each syllable on tone and pronunciation and shows you exactly what to fix. The pronunciation analysis is provided by ToneYin’s own technology.

By using the App’s pronunciation features, you acknowledge and agree that your voice recordings and the text you are practicing will be processed to provide pronunciation feedback. Recordings are processed on ToneYin’s infrastructure and by the service providers described in our Privacy Policy, and we do not use your voice to identify you.

You also acknowledge that copies of your audio recordings may be retained by ToneYin to improve and train our pronunciation-assessment models, as described in the consent notice shown before you record and in our Privacy Policy.

3. Account Registration

To access certain features of the App, you may need to create an account. You can sign in with Sign in with Apple, Google, or an email address and password. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. Subscription Terms

ToneYin may offer premium features through auto-renewing subscription plans. The plans available to you, along with their current prices and any introductory free trial, are shown in the App and on the App Store before you complete a purchase:

• Monthly plan — auto-renewing
• Annual plan — auto-renewing (may include an introductory free trial)

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period.

5. Payment and Billing

All payments are processed through the Apple App Store (and the Google Play Store where the App is available), depending on your device. Payment will be charged to your App Store or Google Play account upon confirmation of purchase. By subscribing, you agree to the respective store’s payment terms.

6. Cancellation Policy

You may cancel your subscription at any time through your App Store or Google Play account settings. Upon cancellation:

• You will retain access to premium features until the end of your current billing period
• No refunds will be provided for partial billing periods
• You can continue to use the free features of the App after your subscription ends

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, audio clips, and software — are the exclusive property of ToneYin LLC and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the App without our prior written consent.

8. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or its servers
• Reverse engineer or decompile any part of the App
• Use the App in any way that could damage or impair the service

9. Limitation of Liability

To the maximum extent permitted by law, ToneYin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

12. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of any material changes by posting the new terms in the App and on this page and updating the “Last updated” date. Your continued use of the App after such changes constitutes your acceptance of the new terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
